These Terms & Conditions govern your access to and use of kywcoa.com and the online services provided by the Kentucky Wildlife Control Operators Association ("KYWCOA," "we," "us," or "our").
1. Acceptance of these terms
By accessing this website, creating an account, submitting information, or using any site feature, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the website. If you use the website on behalf of a business or organization, you represent that you have authority to bind it to these terms.
2. Website purpose
KYWCOA provides association information, educational resources, industry updates, training and career notices, member services, and a public directory of wildlife control operators. Website content is provided for general informational purposes. It is not legal, regulatory, tax, medical, veterinary, safety, or business advice.
Wildlife-control laws, permit requirements, agency guidance, fees, and forms may change. Users are responsible for confirming current requirements directly with the Kentucky Department of Fish and Wildlife Resources and other appropriate authorities.
3. Operator directory and referrals
The public operator directory is a referral resource. Listings may include information obtained from public KDFWR records, information supplied by operators, and member-enhanced profile content approved for publication.
No endorsement or guarantee. A listing, membership badge, claim approval, or publication on this site does not constitute a warranty or endorsement of an operator's licensing status, insurance, availability, pricing, methods, quality, safety, or results.
Consumers must independently evaluate an operator, verify current permits and insurance, request written service terms, and decide whether an operator is appropriate for their needs. Operators are independent businesses and are not employees, agents, partners, or representatives of KYWCOA. KYWCOA is not a party to agreements between consumers and operators and is not responsible for their acts, omissions, disputes, charges, or services.
4. Member accounts and listing claims
You must provide accurate, current information when creating or using an account. You are responsible for safeguarding access to your account and for activity conducted through it. Notify KYWCOA promptly if you believe your account has been accessed without authorization.
- Listing claims are subject to staff verification and may be approved, declined, suspended, or revoked.
- Claiming a listing does not permit you to alter official KDFWR-sourced fields through this website.
- You must promptly update member-supplied information that becomes inaccurate or misleading.
- You may not impersonate another person or claim a business or operator listing without authorization.
We may restrict or terminate access when reasonably necessary to protect the site, enforce these terms, comply with law, or address misuse. Free membership may be changed or discontinued by KYWCOA.
5. User submissions
You retain ownership of content you submit, including profile enhancements, listing-claim explanations, job postings, training notices, links, and other materials. By submitting content intended for publication, you grant KYWCOA a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, edit for clarity, display, and distribute that content for operating and promoting the association and its services.
You represent that your submission is accurate, lawful, not misleading, and that you have all rights and permissions needed to provide it. Do not submit confidential information or another person's personal information without authorization. KYWCOA may review, edit, decline, remove, or unpublish submissions at its discretion and has no obligation to publish any submission.
6. Acceptable use
You agree not to:
- Use the website for unlawful, fraudulent, deceptive, threatening, or abusive activity.
- Submit false claims, infringing content, malware, unsolicited advertising, or harmful code.
- Attempt to access another user's account or restricted administrative systems.
- Interfere with site security, availability, operation, or data integrity.
- Use automated means to scrape, harvest, or republish site data in a manner that burdens the website or violates applicable law.
- Use directory information to send spam or unwanted bulk communications.
7. Intellectual property
Except for user submissions, public records, and third-party materials, the website's design, text, graphics, logos, compilation, and original content are owned by or licensed to KYWCOA and are protected by applicable intellectual-property laws. You may view and print reasonable portions for personal, informational, or legitimate business-reference purposes. You may not copy, sell, modify, frame, or commercially redistribute protected site content without prior written permission.
8. Third-party websites and services
The website links to KDFWR, training providers, social networks, member websites, registration pages, and other third-party services. KYWCOA does not control and is not responsible for their content, availability, security, privacy practices, products, or services. A link does not imply endorsement. Your use of a third-party service is governed by that provider's terms and policies.
9. Disclaimers
To the fullest extent permitted by law, the website and its content are provided "as is" and "as available." KYWCOA disclaims all express and implied warranties, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, security, and uninterrupted availability. We do not warrant that content is current or error-free or that the website will always be available.
10. Limitation of liability
To the fullest extent permitted by law, KYWCOA and its officers, directors, volunteers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits or data, business interruption, personal injury, property damage, wildlife-related loss, or disputes arising from or related to the website, directory, submitted content, third-party links, or operator services.
Nothing in these terms excludes liability that cannot legally be excluded or limited.
11. Changes, severability, and governing law
We may update these terms by posting a revised version with a new effective date. Continued use after an update constitutes acceptance of the revised terms. If any provision is held unenforceable, the remaining provisions remain in effect. These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Any dispute will be brought in a court of competent jurisdiction in Kentucky, unless applicable law requires otherwise.
